Insurance protection for authorised passenger service

A vehicle carrying passengers for payment should have operating permission and insurance arrangements that match its actual use. Hong Kong's Transport Department states that a vehicle's third-party insurance may be invalid if an illegal hire-car service is involved in an accident.

Macau's compulsory motor liability rules also provide that damage to passengers carried in breach of transport rules may fall outside compulsory insurance protection. Choosing a vehicle with the required permissions helps avoid this insurance risk.

Drivers and vehicles must meet the applicable requirements

Macau's taxi regime requires an operating licence, a licence for each taxi and the prescribed vehicle inspections. Drivers must hold a valid taxi driver identity card, and applicants must satisfy specific criminal-record conditions. Macau's inspection service also identifies taxis and other occupational light vehicles as subject to compulsory inspection.

Requirements differ by jurisdiction, vehicle class and route. For a cross-border trip, rely on the vehicle's current permits and inspection documents that apply to that journey.

A paid cross-border transfer needs both operating and border permissions

Hong Kong's Transport Department tells passengers to look for a hire-car permit on the windscreen and a Cross Boundary Hire Car label with the vehicle's serial number at the front and rear. A Hong Kong hire-car permit can also be checked online by registration mark.

The Macao Vehicles Travelling North scheme applies to non-commercial small passenger vehicles. It is a temporary-entry arrangement, not a paid passenger-service licence. The permits and identification needed for a particular journey should be checked against the actual route.

In Hong Kong, following conviction for illegal carriage for hire or reward, a cross-border private car may have its vehicle licence suspended, be impounded and lose its closed-road permit.

• Check the vehicle: look for the hire-car permit and cross-boundary identification required for the journey.
• Check the registration mark: use Hong Kong's online Hire Car Permit service where applicable.
• Check the booking: confirm in writing whether the ride is same-vehicle direct or requires a change at the port.
